1. Agreement to Terms

By accessing or using the services of Rootstead Lawrence Tree Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use of our services constitutes acceptance of any changes.

2. Services Provided

Rootstead Lawrence Tree Service provides professional tree care services including tree removal, tree trimming and pruning, stump grinding and removal, emergency tree services, land and lot clearing, tree health and maintenance, arborist consulting, and shrub and hedge trimming. All services are performed by trained professionals in accordance with industry standards and local regulations.

Service estimates are provided in good faith based on visual inspection and available information. Final costs may vary if conditions differ from initial assessment or if additional work is required for safety or completion. We will communicate any necessary changes before proceeding with additional work.

3. Client Responsibilities

Clients are responsible for providing accurate information about their property, including the location of underground utilities, septic systems, irrigation lines, and other hidden infrastructure. Clients must obtain any necessary permits or approvals required by local authorities before work begins. Failure to disclose known hazards or obtain required permits may result in additional charges or service delays.

Clients must ensure that our crew has clear access to work areas and that pets are secured during service. You are responsible for removing or protecting any items of value in the work area, including outdoor furniture, decorations, and vehicles.

4. Payment Terms

Payment is due upon completion of services unless other arrangements have been made in writing. We accept cash, checks, and major credit cards. For large projects, we may require a deposit before beginning work. Accounts not paid within 30 days of service completion may be subject to late fees and collection actions.

5. Cancellation and Rescheduling

We understand that schedules change. Please provide at least 24 hours notice if you need to cancel or reschedule a service appointment. Cancellations with less than 24 hours notice may be subject to a cancellation fee. For emergency services, different terms may apply.

6. Liability and Insurance

Rootstead Lawrence Tree Service carries comprehensive liability insurance and workers compensation coverage. We take every precaution to protect your property during service, but tree work involves inherent risks. We are not responsible for damage to underground utilities not properly marked, pre-existing damage to trees or property, or damage resulting from hidden defects or conditions not visible during inspection.

Our liability is limited to the cost of services provided. We are not liable for indirect, consequential, or incidental damages. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

7. Warranty and Guarantees

We guarantee that all work will be performed in a professional manner according to industry standards. However, we cannot guarantee the survival or future health of trees, as many factors beyond our control affect tree vitality. We do not warranty against natural events, disease, pest infestation, or environmental conditions.

8. Dispute Resolution

Any disputes arising from these terms or our services will be resolved through good faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in Lawrence, Massachusetts, in accordance with the rules of the American Arbitration Association. Each party will bear their own costs and fees.

9. Governing Law

These Terms of Service are governed by the laws of the Commonwealth of Massachusetts. Any legal action must be brought in the courts of Essex County, Massachusetts.
